Education & School Law

Each state has assumed the responsibility for providing a school system whereby all children may receive a free appropriate public education. There is no charge for attending these public schools, and they are open to students who reside in each respective school district, without regard to disability. In Pennsylvania, there are 501 public School Districts which are primarily responsible for operating the public schools. Generally, each School District has the power to carry out their educational missions and objectives as set forth by the Pennsylvania General Assembly and by the Pennsylvania Department of Education.

In order to make quality education a reality throughout our Central Pennsylvania communities, our experienced and knowledgeable attorneys support our School District clients to enrich our communities and to improve quality of life for all of our citizens. Our experience includes representation of School Districts in areas which include issues under the Individuals with Disabilities in Education Act (the “IDEA”), student discipline, employee discipline, internet usage policies, school security, regulatory compliance and school construction contract drafting and coordination. We provide educators with the knowledge and tools necessary to provide quality education to their students in the classroom environment, while being compliant with the plethora of statutes and regulations which apply.

At Derr, Pursel, Luschas & Naparsteck, LLP, we have the experience, resources and knowledge to provide exceptional legal services in the areas of risk management, labor and employment, finance and investment, governance, domestic transactions, contract law, litigation, premises liability, and regulatory law, including regulations under the IDEA, FERPA and Pennsylvania’s School Code.
