Your Last Will and Testament is the cornerstone of your estate plan. It’s the document that ensures your wishes are honored after you’re gone, outlining how your assets will be distributed among your beneficiaries. One critical consideration for many clients is their homeāthe cornerstone of their legacy. Should you gift your home during your lifetime or include it in your will? The answer requires a deep understanding of tax implications, and that’s where we come in.
Consider this scenario: you purchased your home 30 years ago for $100,000. Fast forward to the present day, and its fair market value is $300,000 at the time of your passing. If you leave the property to your children through your will, the home’s cost basis is adjusted, or “stepped up,” to its current value of $300,000.
Why does this matter? When your children eventually sell the home for $500,000, their taxable gain is calculated by subtracting the stepped-up basis from the sale price ($500,000 – $300,000 = $200,000 gain). This significantly reduces their potential capital gains tax liability.
